Terms of Use
These Terms govern your access to and use of The Vital Years. By reading the Site or contacting us, you agree to them.
These Terms of Use ("Terms") govern your access to and use of the editorial journal published at laappflex.shop (the "Site"), operated by The Vital Years ("The Vital Years," "we," "our," or "us"). By reading the Site or contacting us, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
I.Nature of the Publication
The Vital Years is an independent editorial publication by Giulia Batista. The content here, including letters, archive notes, and any replies to reader correspondence, is offered for general informational and educational purposes only. We are not a medical practice, clinic, or healthcare provider. We do not employ physicians and we do not provide medical services.
II.Not Medical Advice
Nothing on this Site is medical advice, a diagnosis, or a treatment plan, and nothing here is a substitute for the care of a qualified, licensed healthcare professional. Always seek the advice of your physician or other qualified provider with any question about a medical condition. Never disregard professional medical advice, and never delay seeking it, because of anything you read here. If you believe you may be experiencing a medical emergency, contact your local emergency services immediately.
Individual stories shared on the Site reflect the personal experiences of those who wrote them and do not represent typical or expected outcomes. We make no guarantee, warranty, or representation of any specific result.
III.Eligibility
You must be at least 18 years of age to use the Site. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
IV.Use of the Site
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any part of the Site or related systems.
- Interfere with or disrupt the integrity or performance of the Site.
- Submit false, misleading, or fraudulent information via our correspondence channels.
- Use the Site to transmit malware, spam, or any harmful content.
- Scrape, copy, or republish the contents of the Site without prior written permission, except for personal, non-commercial reading and printing.
V.Intellectual Property
All content on the Site, including original letters, text, graphics, layouts, logos, images, and the editorial design itself, is owned by or licensed to The Vital Years and is protected by United States and international copyright, trademark, and other intellectual property laws. You may read, save for personal reference, and print individual pages for non-commercial personal use. You may not reproduce, modify, distribute, publicly display, or create derivative works from any part of the Site without our prior written permission.
VI.Reader Correspondence
When you write to us at [email protected], you grant us a non-exclusive, royalty-free license to read and respond to your message. We may, with your separate explicit consent, quote anonymized excerpts of reader letters in future editions. We will not publish anything that identifies you personally without your express written agreement.
VII.Third-Party Links
The Site may contain links to third-party websites, studies, or publications. We have no control over, and assume no responsibility for, the content, privacy practices, or accuracy of any third-party sources. A link is not an endorsement.
VIII.Disclaimers
THE SITE AND ITS CONTENTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY, EXCEPT AS REQUIRED BY APPLICABLE LAW.
The Vital Years does not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected. We make no representations about the accuracy, reliability, completeness, or timeliness of any content on the Site.
IX.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE VITAL YEARS OR ITS AFFILIATES, OFFICERS, EDITORS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM (a) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE; (b) ANY DECISION YOU MAKE BASED ON THE CONTENT OF THE SITE; OR (c) UNAUTHORIZED ACCESS TO YOUR DATA.
Our total aggregate liability arising out of or relating to these Terms or your use of the Site shall not exceed one hundred U.S. dollars ($100.00 USD).
X.Indemnification
You agree to defend, indemnify, and hold harmless The Vital Years and its affiliates, editors, and contributors from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.
XI.Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [REPLACE: governing state], without regard to its conflict-of-laws provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
XII.Dispute Resolution
Please read carefully, this section affects your rights. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in English.
You and The Vital Years each agree that proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If a claim proceeds in court rather than in arbitration, both parties waive any right to a jury trial. Either party may bring a qualifying claim in small claims court, or seek injunctive relief for intellectual property infringement, notwithstanding this section.
XIII.Changes to These Terms
We may revise these Terms from time to time. The most current version is always posted on this page with the "Last updated" date above. Material changes will be effective fifteen (15) days after they are posted, except where required by law (in which case they are effective immediately).
XIV.Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
